Key points
- Calobook gives nutrition guidance, not medical advice. Its estimates and targets are a starting point to check with your doctor, especially if you are pregnant, breastfeeding or managing a condition.
- Calobook Pro is a subscription billed by Apple or Google. Where offered, a 7-day free trial converts to a paid subscription unless you cancel at least 24 hours before it ends. It renews automatically until you cancel in your store account settings.
- You must be 16 or older. If you are under 18, a parent or guardian must agree to these Terms for you.
- Your data stays yours. You can delete your account and everything in it at any time. Our Privacy Policy explains how we handle it.
- AI output is an estimate. Review and correct it before you save. Nothing in the App is guaranteed to be accurate or to produce a particular result.
The key points are a convenience. The full Terms below are what applies.
1. About these Terms
These Terms of Service ("Terms") are a legal agreement between you and Calobook ("Calobook", "we", "us", "our"), the developer and operator of the Calobook mobile application (the "App"), the Calobook Pro subscription and the website at calobook.app (together, the "Service").
By creating an account, starting a trial, purchasing a subscription or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you downloaded the App from the Apple App Store, section 16 also applies. If you downloaded it from Google Play, section 17 also applies. Where a term required by Apple or Google conflicts with these Terms, the store's required term prevails for the purpose of that requirement only.
We may update these Terms as the Service evolves. For material changes we will give you at least 30 days' notice in the App or by email before the new Terms take effect, unless the change is required by law or addresses a security risk, in which case it may take effect sooner. If you keep using the Service after the effective date you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription before the change takes effect.
2. Who can use Calobook
- You must be at least 16 years old. The App will not accept a lower age during setup, and we delete accounts we learn belong to anyone younger.
- If you are under the age of majority where you live (usually 18), your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Service.
- You must be able to form a binding contract, must not be barred from using the Service under applicable law, and must not use the Service if you are located in a country subject to a comprehensive US embargo or are on a US government list of prohibited or restricted parties.
- You may hold one account for your own personal, non-commercial use. Calobook is not a tool for tracking other people's health, and you may not enter another person's health information without their consent.
Calorie tracking and weight targets can be harmful for some people. Calobook is not designed for the treatment or management of eating disorders. If you are receiving care, use the App only if your care team agrees, and stop if it is not helping you.
3. Not medical advice
Calobook provides general nutrition and fitness information generated from the answers you give it and the food, workouts, weigh-ins and steps you log. It is not medical advice, it is not a medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Using the Service does not create a doctor-patient, dietitian-client or other professional relationship between you and Calobook.
- Calorie and macronutrient targets, guardrails, fit scores, recipe suggestions, weekly adjustments and AI-written notes are estimates and starting points, calculated from standard formulas and from models that can be wrong.
- Nutrition values for photographed meals are approximations of what the model can see. Barcode and label data come from third-party databases and packaging and may be incomplete or out of date. Calorie burn estimates use population averages.
- Always consult a qualified health professional before starting or changing a diet or exercise programme, and before acting on anything in the App if you are pregnant, breastfeeding, under 18, have a medical condition (including diabetes, kidney, liver, heart or thyroid disease), take medication, or have a history of disordered eating. Never disregard professional advice or delay seeking it because of something in the App.
- The App applies safety limits, such as no calorie deficit while pregnant or breastfeeding and a minimum daily calorie floor, but these are general rules and are not tailored to your medical situation. Your health professional's advice takes priority over anything in the App.
- If you think you have a medical emergency, call your local emergency number immediately. The App is not monitored and cannot respond to emergencies.
4. Your account
You need an account to use Calobook. You can create one with Sign in with Apple, Sign in with Google, or an email address and password. You agree to:
- give accurate information during setup and keep it up to date, since your plan is only as good as the answers it is built on;
- keep your credentials confidential and not share your account;
- tell us promptly at support@calobook.app if you suspect unauthorised use;
- be responsible for all activity under your account, unless it results from our failure to secure the Service.
Sign in with Apple and Sign in with Google are provided by Apple and Google under their own terms. You can delete your account at any time in the App (Profile, Delete account); see section 12.
5. The Service
5.1 What Calobook does
Calobook builds a personal nutrition plan from your answers, lets you log meals by photo, barcode, nutrition label or manual entry, scores how each meal fits your body and goals, retunes your targets each week from what you actually logged, curates a monthly set of recipes, tracks weight, steps, water and other progress, and sends reminders you choose. Features may differ by platform and region.
5.2 AI-generated content
Several features use artificial intelligence models operated by third-party providers, as described in our Privacy Policy. AI output can be inaccurate, incomplete or inappropriate despite our safeguards. You are responsible for reviewing it before relying on it, and the App lets you correct any value before saving. If you see AI output that is wrong or objectionable, tell us at support@calobook.app so we can improve it. You may not use the AI features to generate content that is unlawful, harmful or intended to extract information about other users or our systems.
5.3 Third-party data
Packaged food data is provided by fatsecret and Open Food Facts, and recipes by Spoonacular. This data belongs to those providers and their contributors and is provided as is. Recipes link to their original websites, which we do not control. Attribution shown in the App must not be removed.
5.4 Apple Health
If you connect Apple Health, the App reads your step count only, with your permission, and never writes to Apple Health. Your use of Apple Health is governed by Apple's terms. We are not responsible for the accuracy of step data recorded by your device.
5.5 Availability and changes
We work to keep the Service available, but it depends on your device, your network and third-party providers, and may be interrupted for maintenance, updates or reasons outside our control. We may add, change or remove features, and may discontinue the Service with reasonable notice. If we permanently discontinue Calobook Pro while you have paid for a period you cannot use, we will work with the relevant app store to refund the unused portion where the law requires it.
5.6 Updates
The App may download updates automatically. Some features require the current version, a supported operating system and an internet connection. Features described as beta or experimental may be changed or withdrawn without notice.
6. Calobook Pro subscriptions
6.1 What you are buying
After setup, using the App requires an active Calobook Pro subscription or trial. Calobook Pro is an auto-renewing subscription available as a monthly or a yearly plan. The current price, currency and billing period are shown in the App and in the app store before you confirm a purchase. Prices shown on the website are indicative, in US dollars, and may differ by region and over time.
6.2 Billing through Apple and Google
Subscriptions are sold and billed by the Apple App Store or Google Play (each a "Store") through the account you use with that Store, under the Store's terms. Calobook does not process payments and never receives your card details. Tax is charged by the Store where applicable.
6.3 Free trial
Where offered, new subscribers receive a 7-day free trial. You get full access during the trial and nothing is charged at the start. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and the Store charges the price shown when you started the trial. We send a reminder notification before the trial ends if you have allowed notifications, but you remain responsible for cancelling in time. A free trial is available once per person; if you start another subscription after a trial, it begins as a paid period. The Store may apply its own eligibility rules.
6.4 Automatic renewal
Your subscription renews automatically at the end of each billing period for the same period, at the price then in force, and the Store charges your payment method within 24 hours before the renewal date, until you cancel.
6.5 Cancelling
You can cancel at any time in your Store account settings: on iPhone, open Settings, tap your name, then Subscriptions, and choose Calobook; on Android, open the Google Play app, tap your profile, then Payments and subscriptions, then Subscriptions. Cancelling stops future charges; you keep access until the end of the period you already paid for. Deleting the App or your Calobook account does not cancel your subscription. The App's Manage subscription button takes you to the right place.
6.6 Refunds
Because the Store bills you, refunds are handled by the Store under its refund policy. You can request one at reportaproblem.apple.com or through Google Play. Except where the law requires otherwise, payments are not refundable and there are no refunds or credits for partial periods, unused time or downgrades. If you live in the European Economic Area or the United Kingdom you may have a statutory right to withdraw from a purchase within 14 days; the Stores honour this right through their refund processes, and by starting a trial or subscription you acknowledge that access begins immediately.
6.7 Price changes
We may change subscription prices. A price change applies to your next renewal only after we have notified you in advance through the App, by email or through the Store, and only with your consent where the Store or the law requires it. If you do not agree, cancel before the renewal.
6.8 Promotional offers
We may offer introductory, promotional or discounted prices. Unless the offer states otherwise, a promotional price applies to the first billing period only and the subscription then renews at the standard price. Offers may be limited to new subscribers, may be withdrawn at any time, and are subject to Store rules.
6.9 Restoring purchases
Your subscription is linked to your Store account and to your Calobook account. If you reinstall the App or change devices, use Restore purchases in the App. Access requires being signed in to the Calobook account that made the purchase; sharing a subscription across different Calobook accounts is not supported.
6.10 Offline access
To avoid locking you out when you have no connection, the App remembers your last verified subscription state for up to 72 hours. This is a convenience, not an entitlement, and it does not extend a subscription that has ended.
7. Acceptable use
You agree not to:
- use the Service for anything unlawful, or in a way that harms you or anyone else;
- copy, modify, distribute, sell, rent, sublicense or create derivative works of the Service, or reverse engineer, decompile or attempt to extract its source code, except where the law expressly permits it;
- access the Service by automated means, scrape it, or use it to build a competing dataset or product, including by extracting recipes, food data or AI output at scale;
- circumvent or interfere with security, authentication, billing or subscription checks, or access another person's account or data;
- upload content that is unlawful, infringes anyone's rights, contains malware, or is designed to manipulate the AI features (for example, images or text crafted to make the model reveal system instructions or other users' data);
- misrepresent your identity or age, or create accounts for others;
- remove or alter any notices, attributions or trademarks in the Service.
We may investigate suspected violations and suspend or terminate accounts involved in them.
8. Your content and feedback
The photos you take, the descriptions you write, the notes you add and the data you log are your content. You keep all rights to it. You grant Calobook a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display your content solely to operate, secure and improve the Service for you, including sending it to the service providers named in our Privacy Policy for that purpose. This licence ends when you delete the content or your account, except for copies in backups for the period stated in our Privacy Policy.
You are responsible for your content and confirm that you have the rights to it and that it does not violate these Terms. We do not claim ownership of your content and we do not use it to train AI models.
If you send us ideas, suggestions or feedback, you agree that we may use them without obligation to you.
9. Our intellectual property
The Service, including the App, its design, text, graphics, the Calobook name and heart logo, and all software and algorithms behind it, is owned by Calobook or its licensors and protected by copyright, trademark and other laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, as permitted by the Store's usage rules. All rights not expressly granted are reserved. You may not use the Calobook name or logo without our written permission.
10. Third-party services
The Service relies on third parties, including Apple, Google, Supabase, OpenRouter and its model providers, fatsecret, Open Food Facts, Spoonacular, RevenueCat, PostHog and Expo. Their services are governed by their own terms and privacy policies, and we are not responsible for them. Recipes and other content may link to third-party websites; following those links is at your own discretion.
11. Privacy
Our Privacy Policy explains what we collect, including the health information you share, how we use it, who we share it with and your choices. By using the Service you consent to that processing as described there, including the explicit consent we ask for when you answer health questions.
12. Ending the agreement
12.1 By you
You can stop using the Service at any time. Delete your account in the App under Profile, Delete account (or from the subscription screen if you never subscribed). Deletion removes your account and all data linked to it immediately and cannot be undone. Remember to cancel your subscription separately in your Store account, since deleting your account does not cancel it.
12.2 By us
We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable we will notify you and give you a chance to fix the problem first. If we terminate without cause while you have a paid subscription, we will work with the Store to refund the unused portion where the law requires it.
12.3 Effect
When the agreement ends your licence to use the App ends. Sections that by their nature should survive (including sections 3, 8, 9, 13, 14, 15, 18 and 19) survive.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Without limiting section 3, we do not warrant that nutrition estimates, targets, scores, recipes or calorie burn figures are accurate or suitable for you, that following the App will produce any particular health, weight or fitness outcome, or that the Service will be uninterrupted, secure or error-free.
Some jurisdictions do not allow the exclusion of certain warranties. In those places, the exclusions above apply only to the extent permitted, and you may have additional rights as a consumer that these Terms do not limit.
14. Limitation of liability
To the fullest extent permitted by law, Calobook and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or health outcomes, arising out of or related to the Service or these Terms, whether in contract, tort or otherwise, even if we were told of the possibility of such damages. To the same extent, our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the amount you paid for the Service in that period and USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or under mandatory consumer protection laws that apply where you live. If you are a consumer in the European Economic Area or the United Kingdom, we are liable for foreseeable loss caused by our breach of these Terms or our negligence, and these limitations apply only to the extent permitted by your local law.
15. Indemnity
To the extent permitted by law, you agree to defend and indemnify Calobook against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service, or content you submit that infringes someone else's rights. This section does not apply to consumers where local law prohibits it.
16. Apple App Store terms
If you obtained the App from the Apple App Store, the following applies in addition to the rest of these Terms and to Apple's Licensed Application End User License Agreement:
- Acknowledgement. These Terms are between you and Calobook only, not Apple. Apple is not responsible for the App or its content. Calobook, not Apple, is solely responsible for the App.
- Scope of licence. Your licence to use the App is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. Calobook is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- Warranty. Calobook is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Calobook's sole responsibility.
- Product claims. Calobook, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation, including in connection with the App's use of the HealthKit framework.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Calobook, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you are not listed on any US government list of prohibited or restricted parties.
- Developer contact. Questions, complaints and claims about the App go to Calobook at support@calobook.app.
- Third-party terms. You must comply with applicable third-party terms when using the App, for example your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
17. Google Play terms
If you obtained the App from Google Play, your download and any purchases are also subject to the Google Play Terms of Service and Google's refund policies. Google is not a party to these Terms and is not responsible for the App.
18. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Calobook's operator is established, without regard to its conflict of law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and nothing in this section takes away your right to bring a claim in the courts of that country.
If you have a problem, please contact us first at support@calobook.app. We will try to resolve it informally within 30 days. If we cannot, either of us may bring a claim in a court with jurisdiction. Where permitted by law, each of us agrees to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.
19. General
- Entire agreement. These Terms, the Privacy Policy and any Store terms that apply are the whole agreement between you and Calobook about the Service, and replace any earlier agreements.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect and the unenforceable part is applied to the extent permitted.
- No waiver. If we do not enforce a provision, we are not waiving our right to enforce it later.
- Assignment. You may not transfer these Terms or your account to anyone else. We may assign these Terms to a successor in connection with a merger, acquisition or sale of assets, with notice to you.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, network failures and government action.
- Export control. You agree to comply with export and sanctions laws that apply to your use of the App.
- Notices. We may notify you in the App, by push notification or by email to the address on your account. Notices to us go to support@calobook.app.
- Language. These Terms are written in English. If they are translated, the English version governs to the extent permitted by law.
